Všeobecné obchodní podmínky pro poskytování služeb Vila Charleston
čl. I
Předmět všeobecných podmínek
1. ADAMANTIS GROUP, s.r.o., Novákových 59/4, 180 00 Praha 8, IČO: 04363469, zapsaná v OR u Mestského soudu v Praze, spis. značka 280709 C (dále jen Hotel) vydávají tyto Všeobecné obchodní podmínky pro poskytování služeb – ubytování, stravování, wellness procedury a jiných doplňkových služeb (dále jen služby) Klientům, které upravují smluvní vztahy a vymezují práva a povinnosti Hotelu a Klientů.
2. Smluvní vztahy, které nejsou upravené v těchto Všeobecných obchodních podmínkách, se řídí občanským zákoníkem (č. 89/2012 Sb., v platném znění) a obchodním zákoníkem (č. 513/1991 Sb., v platném znění).
čl. II
Objednávání služeb a uzavření smlouvy
1. Pobyt v Hotelu si Klient objedná prostřednictvím rezervačního formuláře na webových stránkách vila-charleston.cz, nebo písemnou objednávkou, kterou zašle poštou, faxem nebo elektronickou poštou na adresu: info@vila-charleston.cz . Po řádně vystavené a podané objednávce je klient svou objednávkou vázán.
2. Vystavená objednávka musí obsahovat tyto podstatné náležitosti:
- jméno a příjmení klienta,
- datum narození a adresa trvalého bydliště,
- telefon,
- název pobytu a počet osob,
- termín a délka pobytu,
- kategorie ubytování
3. Dále objednávka musí obsahovat:
- rozsah ubytovacích, wellness a stravovacích služeb,
- datum vystavení objednávky.
4. Za smluvní vztah spoluúčastníků pobytu, uvedených v objednávce, odpovídá objednávající klient.
5. Objednávka Klienta je návrhem smlouvy a samotná smlouva je uzavřena potvrzením objednávky Hotelem, kterou vzniká mezi Klientem a Hotelem smluvní vztah o prodeji služeb.
6. Zasláním objednávky Hotelu Klient stvrzuje, že se seznámil s těmito Všeobecnými obchodními podmínkami a že s nimi souhlasí. Tyto obchodní podmínky tvoří nedílnou součást uzavřené smlouvy. Tyto Všeobecné obchodní podmínky jsou zobrazeny na webových stránkách Hotelu: www.vila-charleston.cz.
čl. III
Práva a povinnosti smluvních stran
1. Základní práva Klienta:
- právo na poskytnutí služeb v rozsahu a kvalitě dle potvrzené objednávky Hotelem. K čerpání služeb opravňuje Klienta potvrzení pobytu vystavené Hotelem.
- právo na informace o všech skutečnostech, které jsou Hotelu známy, a které se dotýkají objednaných služeb,
- právo na ochranu osobních dat. Uplatněním objednávky vyslovuje Klient souhlas s tím, aby v souladu s ustanovením § 5, odst. 2 a násl. zákona č. 101/2000 Sb., v platném znění Hotel zpracovával chráněné osobní údaje Klienta, včetně rodného čísla, a to výhradně k úkonům, nezbytným pro plnění ze smlouvy a po dobu, která je nezbytná k účelu jejich zpracování.
2. Základní povinnosti Klienta:
- obstarat si všechny potřebné doklady nutné k zajištění služby,
- zajistit souhlas zákonného zástupce při účasti osoby mladší 18-ti let bez jeho doprovodu,
- dostavit se včas a na místo čerpání sjednaných služeb, přičemž se Klient v den nástupu prokáže na recepci průkazem totožnosti, potvrzením objednávky Hotelem a dokladem o zaplacení služeb,
- dodržovat stanovený program a předpisy Hotelu,
- uhradit objednané služby v plné výši a včas před jejich poskytnutím,
- počínat si tak, aby nedocházelo ke škodám na zdraví nebo majetku na úkor ostatních klientů, Hotelu, poskytovatelů služeb a uhradit případnou škodu, kterou Klient způsobil Hotelu nebo ostatním poskytovatelům služeb v rámci čerpání služeb.
3. Povinnosti Hotelu:
- zajistit osobám uvedeným v objednávce poskytnutí služeb specifikovaných v této objednávce v souladu s těmito Všeobecnými obchodními podmínkami a obecně závaznými právními předpisy,
- poskytnout Klientovi služby v termínu, rozsahu a kvalitě dle potvrzené objednávky,
- pravdivě a řádně informovat Klienta o všech skutečnostech, týkajících se sjednaných služeb, které jsou pro plnění ze smlouvy důležité, a které jsou Hotelu známy,
- při zpracovávání osobních údajů Klienta je Hotel povinen dbát, aby klient neutrpěl újmu na svých právech, zejména na právu na zachování lidské důstojnosti, a na ochranu před neoprávněným zasahováním do jeho soukromého a osobního života.
čl. IV
Platební podmínky
1. Všechny ceny pobytů a služeb Hotelu jsou uvedeny v nabídkových listech a v příslušných cenících a zahrnují služby v nich uvedené.
2. Úhradu objednaného pobytu provádí Klient formou 100% zálohy za jím objednané a Hotelem potvrzené služby. Záloha musí být uhrazena nejpozději 30 dnů před nástupem na pobyt, není-li v potvrzení objednávky stanoveno jinak. Je-li pobyt objednán ve lhůtě 30 dnů a méně před nástupem na pobyt, je Klient o způsobu placení pobytu informován v potvrzení pobytu, resp. při podání objednávky pobytu.
3. Způsob úhrady:
- bankovním převodem
- platebními kartami (MasterCard, VISA, Maestro, VISA Elektron)
- bankovním převodem zaměstnavatele - FKSP
- v hotovosti na adrese partnerského hotelu Hotel Adamantino, Pozlovice 337, Pozlovice, 763 26
bankovní spojení: Česká spořitelna, a.s.
číslo účtu: 7779192/0800
4. Nebude-li záloha za pobyt zaplacena v termínu uvedeném v potvrzení pobytu, může Hotel od potvrzené objednávky odstoupit.
5. V případě, že z časových důvodů nebude možné zaplatit pobyt předem, je možné po dohodě pobyt uhradit na místě (platební kartou nebo platbou v hotovosti). Úhrada pobytu musí být provedena na recepci Hotelu, a to před poskytnutím první služby.
6. V den skončení pobytu Hotel vystaví Klientovi účet za čerpané služby, ve kterém taktéž Hotel zúčtuje uhrazenou zálohu, přičemž rozdíl je Klient povinen doplatit v hotovosti buď na recepci hotelu, nejpozději v den skončení pobytu nebo v poslední den čerpání služeb.
čl. V
Odstoupení od smlouvy
1. Klient má právo kdykoliv pobyt zrušit, tj. odstoupit od potvrzené objednávky pobytu. Toto odstoupení musí být provedeno písemnou formou a oznámení o odstoupení musí být prokazatelně doručeno Hotelu. Klient může zrušit potvrzenou závaznou objednávku jen do dne sjednaného nástupu a jen zaplacením částky odstupného (storno poplatku), které činí:
- do 30 dnů před dnem nástupu bez odstupného
- od 29 dnů do 10 dnů před nástupem 20% z celkové ceny pobytu
- od 09 dnů do 03 před dnem nástupu 40% z celkové ceny pobytu
- od 03 dnů do nástupu 100% z celkové ceny pobytu
2. Hotel může od vymáhání storno poplatku ustoupit, jestliže Klient nečerpal služby z vážných důvodů, které byly řádně prokázány. Storno poplatek se nehradí v těchto dohodnutých případech - úmrtí, nemoc klienta, živelná pohroma znemožňující nástup v dohodnutém termínu.
3. V případě stornované objednávky provede Hotel nejpozději do 21 dnů vyúčtování a vrácení zaplacené zálohy Klientovi s odečtenými storno poplatku, pokud tento vznikne.
4. Hotel může odstoupit od potvrzené objednávky z důvodů závažného porušení povinností Klienta (např. neuhrazení včas a v plné výši ceny objednaného pobytu a služeb), stanovených v těchto Všeobecných obchodních podmínkách, a to bez nároku na další plnění.
čl. VI
Reklamace
1. Je-li rozsah nebo kvalita poskytovaných služeb Hotelu prokazatelně nižší než bylo v potvrzené objednávce sjednáno, vzniká Klientovi právo na reklamaci.
2. V případě reklamace služeb je Klient povinen uplatnit své požadavky na nedostatky bez zbytečného odkladu přímo u poskytovatele služby tak, aby mohly být odstraněny ihned na místě. Pokud toto není možné, bude sepsaná s Klientem písemná reklamace.

Informace jsou shromažďovány s cílem usnadnit proces rezervace mezi zákazníkem a poskytovatelem ubytovacích služeb. Nabídnout Vám další služby tam, kde dáváte souhlas k takovým nabídkám a/nebo nám pomohou zlepšit tento proces pro budoucí použití.
K jakým účelům shromažďujeme informace?
- Průběh nebo podpora činnosti rezervačního procesu
- Proces dobrovolné registrace zákazníka k odběru newsletteru
- Statistické používání systému k jeho možnému vylepšení
- Není žádné jiné použití shromážděných informací, především informace nejsou nikdy předány bez souhlasu třetím stranám
Kdo má přístup k některým nebo všem shromážděným informacím?
- Poskytovatel ubytovacích služeb, u kterého se bude realizovat Vaše rezervace
- Poskytovatel webových stránek a rezervačního formuláře
- Instituce, které k tomu mají oprávnění
Jaký přístup garantujeme našim návštěvníkům ke shromážděným informacím, které se jich týkají?
- Přístup ke všem shromážděným informacím je umožněn kdykoliv na požádání
- Pokud jste přesvědčeni, že naše webové stránky nebo systémy shromáždily nesprávné informace nebo chcete jakékoliv informace rozporovat, prosíme, kontaktujte nás.
Podle zmíněného nařízení GDPR o ochraně osobních údajů máte právo vzít svůj souhlas kdykoliv zpět, požadovat po nás zprávy o tom, jaké vaše osobní údaje zpracováváme, požadovat po nás vysvětlení důvodu a zpracování osobních údajů, požádat o přístup k těmto údajům, které můžete opravit nebo aktualizovat, požadovat po nás smazání svých osobních údajů, obrátit se na nás nebo na Úřad pro ochranu osobních údajů, pokud budete mít pochybnosti o dodržování povinností se zpracováním osobních údajů z naší strany.

čl. VII
Závěrečná ustanovení
1. V případě, že vznikne rozpor mezi ustanoveními písemně uzavřené smlouvy a Všeobecnými obchodními podmínkami, mají přednost ustanovení smlouvy.
2. Hotel má právo jednostranným úkonem měnit a doplňovat tyto Všeobecné obchodní podmínky. Jestliže dojde k takové změně, bude nová verze Všeobecných obchodních podmínek zveřejněna na webových stránkách Hotelu www.vila-charleston.cz a bude automaticky přiložena ke všem novým potvrzením objednávky. Nesouhlasí-li Klient se změnou Všeobecných obchodních podmínek pro poskytování služeb, má právo neprodleně od smlouvy odstoupit (nejpozději do 5 dnů od nabytí jejich účinnosti), jinak se má za to, že se změnou Všeobecných obchodních podmínek pro poskytování služeb souhlasí.
3. Ubytovaný host má právo podat návrh na mimosoudní řešení takového sporu určenému subjektu mimosoudního řešení spotřebitelských sporů, kterým je: Česká obchodní inspekce Ústřední inspektorát - oddělení ADR Štěpánská 15 120 00 Praha 2 Email: adr@coi.cz Web: https://adr.coi.cz. Česká obchodní inspekce je dozorovým orgánem vykonávajícím dohled nad ochranou spotřebitele, postupující podle zákona č. 64/1986 Sb., o České obchodní inspekci, ve znění pozdějších předpisů, a dalších právních předpisů. Internetová stránka České obchodní inspekce je www.coi.cz. 2. V souladu s ustanovením § 1837 písmeno j) zákona č. 89/2012 Sb., občanský zákoník ubytovanému jako spotřebiteli nevzniká právo na odstoupení od smlouvy o ubytování, pokud ubytovací zařízení poskytuje plnění v určeném termínu.
4. Pokud některé z ustanovení těchto Všeobecných obchodních podmínek se stane z nějakého důvodu neplatným, nemá tato skutečnost vliv na platnost ostatních ustanovení. To neplatí, stanoví-li kogentní ustanovení občanského zákoníku něco jiného.
5. Tyto Všeobecné obchodní podmínky nabývají platnosti a účinnosti dne 13. března 2016 a ruší všechny předchozí Všeobecné obchodní podmínky.

General Terms and Conditions for the Provision of Services – Vila Charleston
Article I – Subject Matter of the General Terms and Conditions
- ADAMANTIS GROUP, s.r.o., Novákových 59/4, 180 00 Prague 8, Company ID No.: 04363469, registered in the Commercial Register maintained by the Municipal Court in Prague, file No. 280709 C (hereinafter referred to as the “Hotel”), hereby issues these General Terms and Conditions for the provision of services – accommodation, catering, wellness treatments and other ancillary services (hereinafter referred to as the “Services”) to Clients, which govern the contractual relationships and define the rights and obligations of the Hotel and the Clients.
- Contractual relationships not governed by these General Terms and Conditions shall be governed by the Civil Code (Act No. 89/2012 Coll., as amended) and the Commercial Code (Act No. 513/1991 Coll., as amended).
Article II – Ordering of Services and Conclusion of the Contract
- The Client may book a stay at the Hotel via the booking form on the website vila-charleston.cz, or by submitting a written order sent by post, fax or email to: info@vila-charleston.cz. Once a properly completed and submitted order has been placed, the Client is bound by the order.
- The submitted order must contain the following essential particulars:
- client's first and last name,
- date of birth and permanent residential address,
- telephone number,
- name of the stay and number of persons,
- date and duration of the stay,
- accommodation category
- The order must also contain:
- scope of accommodation, wellness and catering services,
- date on which the order was issued.
- The ordering Client shall be responsible for the contractual relationship concerning the other participants of the stay listed in the order.
- The Client’s order constitutes a proposal to conclude a contract, and the contract itself is concluded upon confirmation of the order by the Hotel, whereby a contractual relationship concerning the sale of Services is established between the Client and the Hotel.
- By submitting an order to the Hotel, the Client confirms that they have read these General Terms and Conditions and agree to them. These General Terms and Conditions form an integral part of the concluded contract. These General Terms and Conditions are available on the Hotel's website: www.vila-charleston.cz.
Article III – Rights and Obligations of the Contracting Parties
- Basic rights of the Client:
- the right to receive Services to the extent and at the quality specified in the order confirmed by the Hotel. The Client is entitled to use the Services on the basis of the stay confirmation issued by the Hotel.
- the right to information about all facts known to the Hotel that concern the ordered Services,
- the right to protection of personal data. By placing an order, the Client consents to the Hotel processing the Client’s protected personal data, including their birth number, in accordance with Section 5(2) et seq. of Act No. 101/2000 Coll., as amended, exclusively for actions necessary for the performance of the contract and for the period necessary for the purpose of such processing.
- Basic obligations of the Client:
- to obtain all documents necessary to ensure the provision of the Service,
- to obtain the consent of a legal guardian when a person under 18 years of age participates without being accompanied by their legal guardian,
- to arrive on time and at the place where the agreed Services are to be provided; on the day of arrival, the Client shall present an identity document, the order confirmation issued by the Hotel and proof of payment for the Services at the reception,
- to comply with the established programme and the Hotel's regulations,
- to pay for the ordered Services in full and on time before they are provided,
- to behave in such a way as to prevent damage to the health or property of other Clients, the Hotel or Service Providers, and to compensate for any damage caused by the Client to the Hotel or other Service Providers in connection with the use of the Services.
- Obligations of the Hotel:
- to ensure that the persons listed in the order receive the Services specified therein in accordance with these General Terms and Conditions and generally binding legal regulations,
- to provide the Client with the Services on the date, to the extent and at the quality specified in the confirmed order,
- to truthfully and properly inform the Client of all facts concerning the agreed Services that are important for the performance of the contract and are known to the Hotel,
- when processing the Client’s personal data, the Hotel is obliged to ensure that the Client does not suffer harm to their rights, in particular their right to human dignity and protection against unauthorized interference with their private and personal life.
Article IV – Payment Terms
- All prices of the Hotel's stays and Services are stated in the offer sheets and relevant price lists and include the Services specified therein.
- The Client shall pay for the ordered stay in the form of a 100% advance payment for the Services ordered by the Client and confirmed by the Hotel. The advance payment must be made no later than 30 days before the start of the stay, unless otherwise stated in the order confirmation. If the stay is booked 30 days or less before the start of the stay, the Client shall be informed of the payment method in the stay confirmation or when submitting the stay booking.

- If the advance payment for the stay is not paid by the deadline specified in the stay confirmation, the Hotel may withdraw from the confirmed order.
- If, for time-related reasons, it is not possible to pay for the stay in advance, the stay may, by agreement, be paid for on site (by payment card or in cash). Payment for the stay must be made at the Hotel reception before the first Service is provided.
- On the day the stay ends, the Hotel shall issue the Client with an invoice for the Services used, in which the Hotel shall also account for the advance payment made. The Client shall pay any difference in cash either at the Hotel reception, no later than on the day the stay ends, or on the last day on which the Services are used.
Article V – Withdrawal from the Contract
- The Client has the right to cancel the stay at any time, i.e. to withdraw from the confirmed stay booking. Such withdrawal must be made in writing and the notice of withdrawal must be demonstrably delivered to the Hotel. The Client may cancel the confirmed binding booking only up to the agreed date of arrival and only upon payment of a cancellation fee, which shall amount to:
- up to 30 days before the date of arrival – no cancellation fee
- from 29 days to 10 days before arrival – 20% of the total price of the stay
- from 9 days to 3 days before the date of arrival – 40% of the total price of the stay
- from 3 days before arrival until arrival – 100% of the total price of the stay
- The Hotel may waive the cancellation fee if the Client did not use the Services for serious reasons that have been duly documented. No cancellation fee shall be charged in the following agreed cases: death, illness of the Client, or a natural disaster preventing arrival on the agreed date.
- In the event of a cancelled booking, the Hotel shall, no later than within 21 days, settle the account and refund the advance payment made by the Client, less any applicable cancellation fee.
- The Hotel may withdraw from a confirmed booking due to a serious breach of the Client’s obligations (e.g. failure to pay the price of the ordered stay and Services on time and in full) stipulated in these General Terms and Conditions, without any entitlement to further performance.
Article VI – Complaints
- If the scope or quality of the Services provided by the Hotel is demonstrably lower than agreed in the confirmed order, the Client shall have the right to make a complaint.
- In the event of a complaint concerning the Services, the Client is obliged to raise their claims concerning deficiencies without undue delay directly with the Service Provider so that they can be remedied immediately on site. If this is not possible, a written complaint shall be drawn up with the Client.

- Statistical use of the system for possible improvement
- There is no other use of the collected information; in particular, information is never disclosed to third parties without consent

- The accommodation provider with whom your booking will be made
- The provider of the website and booking form
- Institutions authorized to access such information
What access do we guarantee our visitors to the collected information concerning them?
- Access to all collected information is available at any time upon request
- If you believe that our website or systems have collected incorrect information, or if you wish to dispute any information, please contact us.
Under the aforementioned GDPR regulation on the protection of personal data, you have the right to withdraw your consent at any time, request information about which of your personal data we process, request an explanation of the reason for and processing of personal data, request access to such data, which you may have corrected or updated, request the deletion of your personal data, and contact us or the Office for Personal Data Protection if you have any doubts regarding our compliance with our obligations concerning the processing of personal data.
Article VII – Final Provisions
- In the event of a conflict between the provisions of a written contract and these General Terms and Conditions, the provisions of the contract shall prevail.
- The Hotel has the right to unilaterally amend and supplement these General Terms and Conditions. If such an amendment is made, the new version of the General Terms and Conditions shall be published on the Hotel's website www.vila-charleston.cz and shall automatically be attached to all new order confirmations. If the Client does not agree with the amendment to the General Terms and Conditions for the provision of Services, they have the right to withdraw from the contract immediately (no later than 5 days after the amendment takes effect); otherwise, the Client shall be deemed to have agreed to the amendment to the General Terms and Conditions for the provision of Services.
- The accommodated guest has the right to submit a proposal for out-of-court resolution of such a dispute to the designated entity for out-of-court resolution of consumer disputes, which is: Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, Email: adr@coi.cz, Website: https://adr.coi.cz. The Czech Trade Inspection Authority is the supervisory authority responsible for consumer protection, acting pursuant to Act No. 64/1986 Coll., on the Czech Trade Inspection Authority, as amended, and other legal regulations. The website of the Czech Trade Inspection Authority is www.coi.cz. 2. In accordance with Section 1837(j) of Act No. 89/2012 Coll., the Civil Code, a consumer staying at the accommodation facility does not have the right to withdraw from the accommodation contract if the accommodation facility provides performance on a specified date.
- If any provision of these General Terms and Conditions becomes invalid for any reason, this shall not affect the validity of the remaining provisions. This shall not apply if mandatory provisions of the Civil Code provide otherwise.
- These General Terms and Conditions shall enter into force and effect on 13 March 2016 and shall supersede all previous General Terms and Conditions.

Allgemeine Geschäftsbedingungen für die Erbringung von Dienstleistungen – Vila Charleston
Artikel I – Gegenstand der Allgemeinen Geschäftsbedingungen
- ADAMANTIS GROUP, s.r.o., Novákových 59/4, 180 00 Prag 8, Identifikationsnummer: 04363469, eingetragen im Handelsregister beim Stadtgericht in Prag, Aktenzeichen 280709 C (im Folgenden „Hotel“), erlässt hiermit diese Allgemeinen Geschäftsbedingungen für die Erbringung von Dienstleistungen – Unterkunft, Verpflegung, Wellnessbehandlungen und sonstige Zusatzleistungen (im Folgenden „Dienstleistungen“) an Kunden, die die Vertragsbeziehungen regeln und die Rechte und Pflichten des Hotels und der Kunden festlegen.
- Vertragsbeziehungen, die in diesen Allgemeinen Geschäftsbedingungen nicht geregelt sind, richten sich nach dem Bürgerlichen Gesetzbuch (Gesetz Nr. 89/2012 Slg., in der jeweils geltenden Fassung) und dem Handelsgesetzbuch (Gesetz Nr. 513/1991 Slg., in der jeweils geltenden Fassung).
Artikel II – Bestellung der Dienstleistungen und Vertragsabschluss
- Der Kunde bestellt seinen Aufenthalt im Hotel über das Buchungsformular auf der Website vila-charleston.cz oder durch eine schriftliche Bestellung, die per Post, Fax oder E-Mail an folgende Adresse gesendet wird: info@vila-charleston.cz. Nach ordnungsgemäßer Erstellung und Übermittlung der Bestellung ist der Kunde an seine Bestellung gebunden.
- Die ausgestellte Bestellung muss folgende wesentliche Angaben enthalten:
- Vor- und Nachname des Kunden,
- Geburtsdatum und ständige Wohnanschrift,
- Telefonnummer,
- Bezeichnung des Aufenthalts und Anzahl der Personen,
- Zeitraum und Dauer des Aufenthalts,
- Unterkunftskategorie
- Darüber hinaus muss die Bestellung Folgendes enthalten:
- Umfang der Unterkunfts-, Wellness- und Verpflegungsleistungen,
- Datum der Ausstellung der Bestellung.
- Für das Vertragsverhältnis der in der Bestellung aufgeführten Mitreisenden ist der bestellende Kunde verantwortlich.
- Die Bestellung des Kunden stellt einen Vertragsentwurf dar. Der Vertrag selbst kommt durch die Bestätigung der Bestellung durch das Hotel zustande, wodurch zwischen dem Kunden und dem Hotel ein Vertragsverhältnis über den Verkauf der Dienstleistungen entsteht.
- Mit der Übermittlung der Bestellung an das Hotel bestätigt der Kunde, dass er diese Allgemeinen Geschäftsbedingungen zur Kenntnis genommen hat und ihnen zustimmt. Diese Allgemeinen Geschäftsbedingungen sind Bestandteil des geschlossenen Vertrages. Diese Allgemeinen Geschäftsbedingungen sind auf der Website des Hotels abrufbar: www.vila-charleston.cz.
Artikel III – Rechte und Pflichten der Vertragsparteien
- Grundlegende Rechte des Kunden:
- das Recht auf Erbringung der Dienstleistungen in dem Umfang und in der Qualität, die in der vom Hotel bestätigten Bestellung vereinbart wurden. Zur Inanspruchnahme der Dienstleistungen berechtigt die vom Hotel ausgestellte Aufenthaltsbestätigung.
- das Recht auf Informationen über alle dem Hotel bekannten Tatsachen, die sich auf die bestellten Dienstleistungen beziehen,
- das Recht auf Schutz personenbezogener Daten. Mit der Aufgabe der Bestellung erteilt der Kunde seine Einwilligung dazu, dass das Hotel gemäß § 5 Abs. 2 ff. des Gesetzes Nr. 101/2000 Slg. in der jeweils geltenden Fassung die geschützten personenbezogenen Daten des Kunden, einschließlich der Geburtsnummer, ausschließlich für Handlungen verarbeitet, die zur Erfüllung des Vertrages erforderlich sind, und zwar für den Zeitraum, der für den Zweck der Verarbeitung erforderlich ist.
- Grundlegende Pflichten des Kunden:
- alle erforderlichen Unterlagen zu beschaffen, die zur Sicherstellung der Dienstleistung erforderlich sind,
- bei der Teilnahme einer Person unter 18 Jahren ohne Begleitung die Zustimmung des gesetzlichen Vertreters einzuholen,
- rechtzeitig am Ort der vereinbarten Dienstleistungen zu erscheinen; am Tag der Anreise weist sich der Kunde an der Rezeption mit einem Identitätsnachweis, der vom Hotel ausgestellten Buchungsbestätigung und einem Zahlungsnachweis für die Dienstleistungen aus,
- das festgelegte Programm und die Vorschriften des Hotels einzuhalten,
- die bestellten Dienstleistungen vollständig und rechtzeitig vor ihrer Erbringung zu bezahlen,
- sich so zu verhalten, dass keine Schäden an der Gesundheit oder am Eigentum anderer Kunden, des Hotels oder der Dienstleister entstehen, und für etwaige Schäden aufzukommen, die der Kunde dem Hotel oder anderen Dienstleistern im Rahmen der Inanspruchnahme der Dienstleistungen verursacht hat.
- Pflichten des Hotels:
- sicherzustellen, dass die in der Bestellung aufgeführten Personen die darin angegebenen Dienstleistungen gemäß diesen Allgemeinen Geschäftsbedingungen und den allgemein verbindlichen Rechtsvorschriften erhalten,
- dem Kunden die Dienstleistungen zum vereinbarten Termin, in dem vereinbarten Umfang und in der vereinbarten Qualität gemäß der bestätigten Bestellung bereitzustellen,
- den Kunden wahrheitsgemäß und ordnungsgemäß über alle Tatsachen im Zusammenhang mit den vereinbarten Dienstleistungen zu informieren, die für die Vertragserfüllung von Bedeutung und dem Hotel bekannt sind,
- bei der Verarbeitung personenbezogener Daten des Kunden darauf zu achten, dass der Kunde keinen Schaden an seinen Rechten erleidet, insbesondere nicht an seinem Recht auf Wahrung der Menschenwürde und auf Schutz vor unbefugten Eingriffen in sein Privat- und Persönlichkeitsleben.
Artikel IV – Zahlungsbedingungen
- Alle Preise für Aufenthalte und Dienstleistungen des Hotels sind in den Angebotsunterlagen und den entsprechenden Preislisten angegeben und enthalten die darin aufgeführten Dienstleistungen.
- Der Kunde bezahlt den bestellten Aufenthalt in Form einer 100%igen Vorauszahlung für die von ihm bestellten und vom Hotel bestätigten Dienstleistungen. Die Vorauszahlung muss spätestens 30 Tage vor Beginn des Aufenthalts geleistet werden, sofern in der Buchungsbestätigung nichts anderes festgelegt ist. Wird der Aufenthalt innerhalb von 30 Tagen oder weniger vor Beginn des Aufenthalts gebucht, wird der Kunde über die Zahlungsweise in der Aufenthaltsbestätigung bzw. bei der Buchung des Aufenthalts informiert.

Kontonummer: 7779192/0800- Wird die Vorauszahlung für den Aufenthalt nicht innerhalb der in der Aufenthaltsbestätigung angegebenen Frist bezahlt, kann das Hotel von der bestätigten Bestellung zurücktreten.
- Sollte es aus zeitlichen Gründen nicht möglich sein, den Aufenthalt im Voraus zu bezahlen, kann der Aufenthalt nach Vereinbarung vor Ort bezahlt werden (per Zahlungskarte oder in bar). Die Zahlung des Aufenthalts muss an der Rezeption des Hotels vor Erbringung der ersten Dienstleistung erfolgen.
- Am Tag der Beendigung des Aufenthalts stellt das Hotel dem Kunden eine Rechnung über die in Anspruch genommenen Dienstleistungen aus, in der auch die geleistete Vorauszahlung verrechnet wird. Die Differenz ist vom Kunden in bar entweder an der Hotelrezeption, spätestens am Tag der Beendigung des Aufenthalts, oder am letzten Tag der Inanspruchnahme der Dienstleistungen zu begleichen.
Artikel V – Rücktritt vom Vertrag
- Der Kunde hat das Recht, den Aufenthalt jederzeit zu stornieren, d. h. von der bestätigten Aufenthaltsbuchung zurückzutreten. Der Rücktritt muss schriftlich erfolgen und die Rücktrittserklärung muss nachweislich beim Hotel eingegangen sein. Der Kunde kann die bestätigte verbindliche Buchung nur bis zum vereinbarten Anreisetag und nur gegen Zahlung einer Stornogebühr stornieren, die wie folgt beträgt:
- bis 30 Tage vor dem Anreisetag – keine Stornogebühr
- 29 bis 10 Tage vor der Anreise – 20 % des Gesamtpreises des Aufenthalts
- 9 bis 3 Tage vor dem Anreisetag – 40 % des Gesamtpreises des Aufenthalts
- 3 Tage vor der Anreise bis zum Anreisetag – 100 % des Gesamtpreises des Aufenthalts
- Das Hotel kann auf die Erhebung der Stornogebühr verzichten, wenn der Kunde die Dienstleistungen aus schwerwiegenden Gründen, die ordnungsgemäß nachgewiesen wurden, nicht in Anspruch genommen hat. In den folgenden vereinbarten Fällen wird keine Stornogebühr erhoben: Tod, Erkrankung des Kunden oder eine Naturkatastrophe, die die Anreise zum vereinbarten Termin unmöglich macht.
- Im Falle einer stornierten Buchung nimmt das Hotel spätestens innerhalb von 21 Tagen die Abrechnung vor und erstattet dem Kunden die geleistete Vorauszahlung abzüglich einer gegebenenfalls anfallenden Stornogebühr.
- Das Hotel kann aus Gründen einer schwerwiegenden Verletzung der Pflichten des Kunden (z. B. nicht rechtzeitige oder nicht vollständige Bezahlung des Preises für den bestellten Aufenthalt und die Dienstleistungen), die in diesen Allgemeinen Geschäftsbedingungen festgelegt sind, von der bestätigten Buchung zurücktreten, ohne dass ein Anspruch auf weitere Leistungen besteht.
Artikel VI – Reklamationen
- Ist der Umfang oder die Qualität der vom Hotel erbrachten Dienstleistungen nachweislich geringer als in der bestätigten Bestellung vereinbart, hat der Kunde das Recht, eine Reklamation geltend zu machen.
- Im Falle einer Reklamation bezüglich der Dienstleistungen ist der Kunde verpflichtet, seine Beanstandungen hinsichtlich der Mängel unverzüglich direkt beim Dienstleister geltend zu machen, damit diese unmittelbar vor Ort behoben werden können. Ist dies nicht möglich, wird gemeinsam mit dem Kunden eine schriftliche Reklamation aufgenommen.

Artikel VII – Schlussbestimmungen
- Im Falle eines Widerspruchs zwischen den Bestimmungen eines schriftlich geschlossenen Vertrages und diesen Allgemeinen Geschäftsbedingungen haben die Bestimmungen des Vertrages Vorrang.
- Das Hotel ist berechtigt, diese Allgemeinen Geschäftsbedingungen durch einseitige Erklärung zu ändern und zu ergänzen. Im Falle einer solchen Änderung wird die neue Fassung der Allgemeinen Geschäftsbedingungen auf der Website des Hotels www.vila-charleston.cz veröffentlicht und automatisch allen neuen Buchungsbestätigungen beigefügt. Ist der Kunde mit der Änderung der Allgemeinen Geschäftsbedingungen für die Erbringung von Dienstleistungen nicht einverstanden, hat er das Recht, unverzüglich vom Vertrag zurückzutreten (spätestens innerhalb von 5 Tagen nach Inkrafttreten der Änderung); andernfalls gilt die Änderung der Allgemeinen Geschäftsbedingungen für die Erbringung von Dienstleistungen als vom Kunden akzeptiert.
- Der beherbergte Gast hat das Recht, einen Antrag auf außergerichtliche Beilegung eines solchen Streits bei der hierfür bestimmten Stelle für die außergerichtliche Beilegung von Verbraucherstreitigkeiten einzureichen, nämlich: Tschechische Handelsinspektion, Zentralinspektorat – Abteilung ADR, Štěpánská 15, 120 00 Prag 2, E-Mail: adr@coi.cz, Website: https://adr.coi.cz. Die Tschechische Handelsinspektion ist die Aufsichtsbehörde für den Verbraucherschutz und handelt gemäß dem Gesetz Nr. 64/1986 Slg. über die Tschechische Handelsinspektion in der jeweils geltenden Fassung sowie nach weiteren Rechtsvorschriften. Gemäß § 1837 Buchstabe j) des Gesetzes Nr. 89/2012 Slg., Bürgerliches Gesetzbuch, steht dem untergebrachten Verbraucher kein Recht auf Rücktritt vom Beherbergungsvertrag zu, wenn die Beherbergungseinrichtung die Leistung zu einem bestimmten Termin erbringt.
- Sollte eine Bestimmung dieser Allgemeinen Geschäftsbedingungen aus irgendeinem Grund unwirksam werden, hat dies keinen Einfluss auf die Gültigkeit der übrigen Bestimmungen. Dies gilt nicht, wenn zwingende Bestimmungen des Bürgerlichen Gesetzbuches etwas anderes bestimmen.
- Diese Allgemeinen Geschäftsbedingungen treten am 13. März 2016 in Kraft und Wirksamkeit und ersetzen alle vorherigen Allgemeinen Geschäftsbedingungen.
